through its decision which held that picketing to obtain a contract clause which is within the construction industry proviso to Section 8 (e) is not a violation of Section 8 (b) (4) (A).
Once a "Hot-Cargo" clause has been obtained, the question arises as to what means a labor organization may use to enforce it without violation of the Labor Relations Act. In Sheet Metal Workers v. Hardy Corporation 332 F 2d 682 (1964), Hardy subcontracted work in violation of a "Hot-Cargo" clause. The union filed an action seeking damages for breach of contract. The District Court, relying on earlier cases, denied relief to the union. However, on appeal, the Fifth Circuit reversed on the grounds that the District Court's opinion would create the anomalous situation of having an agreement valid under one section of the National Labor Relations Act but unenforceable by threat, coercion or restraint under another section, so as to be of little or no value. The Court held that coercion prohibited under Section 8 (b) (4) (A) does not preclude judicial enforcement of a valid "Hot-Cargo" clause obtained pursuant to Section 8 (e).
It now seems that the union may strike for the inclusion of a Hot-Cargo provision in a collective bargaining agreement. It is now also clear that when a Hot-Cargo clause is part of a collective bargaining agreement that should the contractor violate the Hot-Cargo clause the union may picket the job on which the violation occurs. In addition to picketing the job in the case of a violation, the union also now apparently has the right to go into court and ask for an injunction directing the contractor not to violate the Hot-Cargo clause.
