statute and judicial interpretation, the author's private view is that punitive damages are (a) uninsurable when granted as pure punishment for a wrong directly committed by the insured, (b) at least doubtful when the ultimate cost would be passed on down to the insurance-buying public if it were covered by insurance, but (c) should be covered when awarded as compensatory damages based upon the degree of injury sustained without splitting the award between the actual damages and the penalty.

THE COVER PHOTO

This space-saving fireplace draws its attractiveness from its simple design and soft textures of its new brick, manufactured with an antique patina. The placement shows how a fireplace can be used to define a separation between two living areas. The interior shown is in the Techbilt House, in Cambridge, Mass., designed by architect Carl Koch of Cambridge.
