EXCLUSIONS

Exclusions under Umbrella Excess Liability policies are relatively few, but very important. They usually include:

1. Liability for expected or intended injury or property damage.
2. Liability assumed under contract, unless such liability would have existed even in the absence of the contract.
3. Liability for injury to employees.
4. Liability arising out of the ownership, maintenance, use, loading or unloading of any aircraft.
5. Liability arising out of the ownership, maintenance, use, loading or unloading of any watercraft.
6. Liability arising out of the ownership, maintenance, use, loading or unloading of any automobile.
7. Liability arising out of the discharge, dispersal, release or escape of pollutants.
8. Liability arising out of the handling of products.
9. Liability arising out of faulty workmanship.
10. Liability for damage to the insured's products.
11. Liability for damage to the insured's work.
12. Liability for damage to impaired property or property not physically injured.
13. Liability for professional services.
14. Liability for war.
15. Liability for nuclear energy.

It should be noted that the above list is not exhaustive, and that the specific exclusions may vary from policy to policy.

One exclusion that is particularly important is the exclusion for liability arising out of the ownership, maintenance, use, loading or unloading of any automobile. This exclusion is intended to prevent the Umbrella Excess Liability policy from providing coverage for liability that is already covered by the insured's automobile liability policy.

Another important exclusion is the exclusion for liability arising out of the discharge, dispersal, release or escape of pollutants. This exclusion is intended to prevent the Umbrella Excess Liability policy from providing coverage for liability that is already covered by the insured's pollution liability policy.

Finally, it is important to note that the Umbrella Excess Liability policy does not provide coverage for punitive damages. Punitive damages are damages that are awarded to punish the defendant for their conduct, and they are not intended to compensate the plaintiff for their losses.


OTHER EXCLUSIONS

There are other exclusions that are more specialized in nature. For example, there is usually an exclusion eliminating coverage for liability arising out of the use of non-approved Aircraft. There is also usually an exclusion eliminating coverage for liability arising out of the use of non-approved Watercraft. There is also usually an exclusion eliminating coverage for liability arising out of the use of non-approved Automobiles.

There is also usually an exclusion eliminating coverage for liability arising out of the discharge, dispersal, release or escape of pollutants. This exclusion is intended to prevent the Umbrella Excess Liability policy from providing coverage for liability that is already covered by the insured's pollution liability policy.

Finally, it is important to note that the Umbrella Excess Liability policy does not provide coverage for punitive damages. Punitive damages are damages that are awarded to punish the defendant for their conduct, and they are not intended to compensate the plaintiff for their losses.


UNINSURABLE HAZARDS

There are certain hazards that are simply uninsurable. For example, it would be impossible to provide insurance for liability arising from the insured's intentional acts. It would also be impossible to provide insurance for liability arising from the insured's criminal acts. It would also be impossible to provide insurance for liability arising from the insured's fraudulent acts.

It would also be impossible to provide insurance for liability arising from the insured's gross negligence. Gross negligence is negligence that is so extreme that it amounts to a reckless disregard for the safety of others.

Finally, it would be impossible to provide insurance for liability arising from the insured's willful misconduct. Willful misconduct is conduct that is intentional and malicious.

Another example of an uninsurable hazard is liability arising from the insured's failure to comply with the law. For example, if the insured violates a building code and as a result someone is injured, the insured would be liable for the injury. However, the insured would not be able to obtain insurance to cover this liability.

Another example of an uninsurable hazard is liability arising from the insured's failure to maintain their property in a safe condition. For example, if the insured fails to repair a broken step on their property and as a result someone is injured, the insured would be liable for the injury. However, the insured would not be able to obtain insurance to cover this liability.
