Important Facts Concerning NLRB Decision

The recently issued decision of the National Labor Relations Board that awarded the scaffolding work of Stebbens Engineering & Mfg. Co. to its employees who are members of the Laborers' Union is one that should be carefully read by all Mason Contractors.

The decision was reported in the May issue of Masonry and involved many factors found in most jurisdictional dispute cases. The National Labor Relations Board rejected the claim of the Carpenters' Union for the work and based its decision on the evidence that was presented at the 10(k) hearing.

The basis for the decision and the factors that were considered important were:

1) Stebbins Engineering & Mfg. Co. was a member of MCAA and therefore, is subject to the contract between MCAA and Laborers' International Union.

2) Stebbins assigned the work to members of the Laborers' Union.

3) The MCAA survey indicated that our members "overwhelmingly" preferred to use members of the Laborers' Union.

4) The use of Carpenters for scaffolding would be inefficient as compared to the ability of laborers to assist bricklayers when not erecting scaffolding.

This decision is significant; however, because of its clarity, the continued acceptance of the international agreement between MCAA and the Laborers' International Union and the reference to the scaffolding survey taken of our members.

Finally, the decision specifically referred to the fact that Stebbins Engineering & Mfg. Co. was acting in keeping with the Jurisdictional Disputes Manual of MCAA which is commonly referred to as the "Rose Book."
