You additional time, in addition to added material costs. If you want to use equipment other than the item specified, have it added as an approved "equal" via an amendment to the original bid package prior to the time bids are taken.
Q: When must a mason contractor actually file a claim?
You file a claim when there is a dispute over compensation that cannot be resolved. The best time to file is when all the events and associated costs of the dispute are known. Filing may be at any time in the job, but must be based on your best business judgement.
Unless you use a comprehensive cost control system, the amount of money to be claimed cannot be fully determined until the end of the job when all the invoices and manhours used can be determined. As a result, most claims are filed toward the end of the job. By then you are aware of the impact the delays and changes have caused on your work and can accurately predict the amount of cost to complete the work. With a proper method of documentation, you can include a certain portion of the additional cost claimed on change orders issued during the course of construction.
Consider these significant points prior to initiating a claim, and during the course of the job performance. If you file a claim:
• The general contractor or owner may have the right to without payment, if a claim is filed.
• The owner may unnecessarily reject certain work and materials or scrutinize every action you make on the job, a situation which could possibly cause additional problems.
• The good will and cooperation which had been in existence on the job may be lost.
• Getting answers to questions may take more time causing additional losses of productivity on the job.
