# Sexual Harassment
A Reasonable Woman Standard
WHAT IS AND IS NOT sexual harassment is often quite different in different perspectives, experiences and and upbringing of men and women. Women establish what is acceptable and unacceptable behavior from males around them by telling them so. Once a woman has made it clear to a coworker or a supervisor that a certain behavior or action is unacceptable to her, the man's repeating the unacceptable behavior (e.g., subsequent requests for dates after a clear and convincing "no thanks") can be sexual harassment.
When a woman fails to make it clear to her coworkers or supervisor what is unacceptable behavior toward her, her sexual harassment claim may fail. "A plaintiff must show that at some point she clearly made her coworkers and supervisors aware of the fact that in the future she would consider such conduct to be 'unwelcomed.' An employee's willing and frequent involvement in the sexual innuendos prevalent in her work area indicated that she did not find such conduct truly 'unwelcomed' or hostile." Weinsheimer v. Rockwell Intl'l Corp., 754F.Supp 1559 (1990), Middle Federal District Court, Florida.
The EEOC judges conduct from the viewpoint of the female employee. So do the courts: "A 'reasonable woman' standard should be used to analyze the 'severity' of alleged sexual harassment because the sex-blind 'reasonable person' standard is male-biased and tends to ignore the experiences of women. Since men and women may have different perspectives on conduct, and because women are disproportionately victims of sexual violence, men may lack a full appreciation of the underlying threat of violence that a woman can reasonably perceive from certain conduct."
