tractors Association of America), the American Subcontractors Association and the Associated Specialty Contractors-have endorsed a new subcontract form.
The new form is the result of over two years' work by members of a task force representing the three associations. This process began with formulation of a concept paper that expressed, in lay terms, the principles of the proposed new document. The concept was then drafted in legal language which was, in turn, resubmitted to the task force for extensive review and revision during a lengthy negotiation process. The final document was approved by the boards of all three associations.
The negotiation among task force members was concentrated on designing a form that would allocate risk fairly, treat both parties equally, recognize the current realities of the construction industry, and confine contract coverage to issues that are the norm, rather than the exception. It is expected that the new subcontract form will improve conditions in the construction industry as a whole, and that use of a uniform subcontract document will simplify contractual relationships between general contractors and subcontractors.
Lull Industries Sues Two Firms
LULL INDUSTRIES has brought suit in the federal district court in Minneapolis against Pettibone Corporation and Traverse Lift Company, a wholly-owned subsidiary of Pettibone. In its suit, Lull claims that Pettibone and Traverse are infringing patent rights owned by Lull, have breached written confidentiality agreements and have misappropriated Lull trade secrets.
Lull claims that Pettibone and its subsidiary gained access to the old Lull Corporation's proprietary business information relating to a specialized line of telescoping boom forklifts, while the company was being marketed to potential buyers. To gain that access, however, Pettibone agreed to maintain confidentiality and refrain from directly or indirectly using the information competitively.
In the suit, Lull claims Traverse's newly introduced forklift is not only similar to Lull's, but infringes Lull's patent rights pertaining to the specialized forklift. Lull also asserts that Pettibone and Traverse have pro-
