ASA Disputes

The American Subcontractors Association joined the ASA Midwest Council in a "friend of the court" brief before the U.S. Court of Appeals. Involved in a case in which the Internal Revenue Service claims it should be paid first for taxes owed by a general contractor out of funds being held by an owner for work performed by sub contractors.

"This is a case of extreme importance to the subcontracting community, said an ASA spokesman. "If the IRS should prevail, subcontractors in future cases involving funds held by owners would lose out to competing interests of the general contractor, their creditors and the IRS.

"The IRS believes it should have priority for claims for funds held by the owner, even if those funds have been earmarked for subcontractors for work they've performed. We made it clear in our brief that the money held by the owner is money held in trust for the benefit of subcontractors who have provided improvements in the owner's property."

Problems:

In general, we need a more professional look to our correspondence. Spelling and grammar are sometimes a problem.

My staff is spending too much time filling out the same forms over and over-proposals, waivers, contracts, government forms and others. Just a small change requires re-typing an entire document.

Solution:

Use word processing software. The cost of a word processor is generally modest, ranging from $150 to $400. It will take one to two weeks to start using it effectively in the office.

A good word processor is much more than a glorified typewriter. It can check spelling and grammar. It can help keep the many key documents used in a contractor's office organized and available. Electronic copies of correspondence are often easier to find than a letter that was never properly filed.

Architects and owners are demanding many alternates for the same job. This requires re-adding many columns of numbers and is a potential source of errors.
