Failures Down
ONLY 8,301 contractors went under last year, 21 percent fewer than in the previous year, according to a recent Dun and Bradstreet report. Even more significant, according to the report, was the fact that contractor liabilities fell 45 percent last year to $1.2-billion, compared to 1993. Construction fared better than overall business, where failures declined 17 percent and liabilities fell 38 percent.

A WHITESIDE, Ohio painting contractor was recently awarded a $48,613 judgement against Chilicothe, Ohio general contractor Allen Ballew for failing to pay for the subcontractor's work. Because the suit was litigated under the state's prompt pay statues, adopted in 1990, the subcontractor was also able to collect interest and attorney fees, doubling the recovery.
