AGC Announces Formal Position on the AGC/ASA/ASC Standard Form Subcontract

After numerous reports that the Associated General Contractors of America had withdrawn support of the AGC/ASA/ASC Standard Form Construction Subcontract (AGC Document No. 640), the AGC published their official position in their August 8 "Newsletter."

"Contrary to published reports, AGC has not withdrawn the AGC/ASA/ASC "Standard Form Construction Subcontract" nor changed its position regarding that document since its approval by AGC's Board of Directors at its 1994 Convention. AGC, ASA, and ASC created, approved, and published the "Standard Form Construction Subcontract" to further two common goals: the timely, economical, and dispute-free delivery of construction services to our customers, and the enhancement of ethical relations between general contractors and subcontractors. AGC reiterates that it has not renounced these goals, and continues to jointly publish and sell "Standard Form Construction Subcontract" to meet the specific needs of its members. AGC and ASC also recognize that no standard form contract can be, or should be mandated for use by its members, and that no single form of contract can possibly meet every individual member's requirements.

AGC and ASC also emphasize that prompt payment by owners is a critical component of a successful team relationship between general contractors and subcontractors. The statement from the AGC came after a June 10 meeting with officials from the AGC and ASC who met to hammer out differences of payment clauses in the document. During that same meeting, representatives from the AGC, ASC and ASA agreed to make educating of construction customers a top priority with regards to prompt payment and the cost savings resulting from general contractors and subcontractors being paid promptly for timely work. The Mason Contractors Association of America is a member of the ASC.
