AIA Document A201: General Conditions of the Contract for Construction (1997 Edition)

11.2.1 Requires that owners obtain a new form of insurance to protect the architect, contractor and owner against liability for their vicarious acts. This is intended to discourage the need for contractors (and subcontractors) to name others as additional insureds or be required to furnish Owners and Contractors Protective (OCP) coverage.

11.3.3 The owner (and contractor) is not allowed to require that the contractor (or subcontractors) name them as additional insureds.

11.4.1 Requires owners to purchase and maintain all risk property insurance for the total value of the project, including subsequent contract modifications.

11.4.1.1 Requires that owner property insurance include earthquake, flood, windstorm, testing and start-up, in addition to previously prescribed hazards. This owner insurance is intended to cover the work and material of all trades, including subcontractors and sub- subcontractors.

11.4.1.3 Obligates owner to pay for property damage losses not covered because of deductibles in their all risk property insurance policies.

11.4.1.4 Extends owner's obligation to provide all risk insurance to cover materials in transit and materials stored off-site. Previously the owner insurance for off-site material was limited to storage approved in advance by the owner.

12.2.2.1 Clarifies that an owner's failure to notify a contractor of deficient work within one year after substantial completion constitutes a waiver of rights to require correction or to make a claim for breach of warranty.

13.2.2 Requires that assignment of the contract to the lender by an owner must include assumption by the lender of owner's obligations and rights under the contract.

14.3.2 Entitles contractors (and subcontractors) to adjustment of both contract time and contract sum due to owner suspension, delay or interruption of project work for owner's convenience.

14.4.3 Entitles contractors (and subcontractors) to payment for work executed and costs incurred, plus reasonable overhead and profit, including profit on work not executed, if the owner terminates the contract for its convenience.
