# U.S. Department of Labor Seeks Re-Run of BAC Election
On April 19, the U.S. Department of Labor filed suit in Federal District Court to seek a re-run of the election of officers to the Bricklayers and Allied Craftsmen. The suit, filed by Labor Secretary Reich versus the IUBAC, was filed in response to a complaint from L. Gerald Carlisle, former secretary-treasurer for the BAC in which objections were raised regarding the fairness of the election. Carlisle narrowly lost his bid to become President of the BAC over incumbent Jack Joyce who was seeking his fourth five year term. Joyce won reelection by 1,995 votes out of 88,235 votes cast.
According to published reports in both the April 29 issue of ENR and the April 24 issue of Construction Labor Report, four separate charges were filed by the Labor Department which may have affected the outcome of the union election. Two of the charges relate to members not being given reasonable opportunity to nominate delegates and the use of union funds to promote the candidacies of the incumbent slate.
The filing "validates the objection we raised regarding the fairness of the election. We know from evidence submitted that there was widespread use of union funds for payment of personal use of union equipment and resources in the Joyce campaign," Gerald Carlisle said. Reports from BAC President Jack Joyce insist that the BAC "will contest the suit" by the Department of Labor.
The last time a re-run election occurred in the BAC was in 1973 when the Department of Labor found defects in local delegate elections. No time frame has been given as to the length of the suit or when a new election will be called. The new election would be conducted by the Department of Labor.
