Handle Record Number of Cases in 1963
A record 25,371 cases were received by the NLRB in fiscal 1963, a natural development, the agency says, since its operation is based on constant industrial, social and economic changes. Key factors contributing to this rising intake are the Landrum-Griffin Act, national economic growth, geographic shifts in industry and automation.
Other board marks set include an all-time annual high of 14,166 unfair labor practice charges, 5 per cent more than the previous year, and the processing of 13,605 unfair labor practice cases, also a new record. Of these unfair labor practice charges, 6,345, or 45 per cent, were filed by unions; 5,495, or 39 per cent, by individuals; and 2,325, or 16 per cent, by employers. Two-thirds of all complaints were filed against employers of which unions filed 64 per cent. This was a 3.5 per cent jump over 1962. Of the charges against unions, half were filed by employers, 46 per cent by individuals and the remainder by unions against unions.
There were also some significant changes in the types of unfair labor practice complaints filed. Of those filed against unions, 53 per cent were for the restraint of employees, a 19 per cent increase over fiscal 1962; 39 per cent for alleged discrimination against employees, up 7 per cent; and 8 per cent for illegal picketing, a decline of 12 per cent. Secondary boycott and jurisdictional dispute charges showed little change, continuing to account for 32 per cent of the total. Illegal discharge or other forms of discrimination accounted for 72 per cent of all complaints filed against employers, a 3 per cent drop, and refusal to bargain charges represented 27 per cent of the total, up 2 per cent.
Other statistical highlights included: 1) The issuance of 1,588 formal complaints involving 2,043 unfair labor practice cases by the Office of the General Counsel, an increase of 199 complaints over the previous high of fiscal 1962; 2) The carry-over into the next year of 110 fewer cases awaiting board decision; and 3) A total of $2.7 million collected in back pay for 6,965 employees discriminated against by employers, unions or both. Reinstatement was offered to 3,478 employees.
