Insurance For Contractors

(continued from page 6)

POLICY EXCLUSIONS AND LIMITATIONS

# "Caused by Accident"

Here, too, the Bodily Injury and Property Damage Agreements limit coverage to injury or damage caused by accident. It is less of a problem with Automobile hazards than General Liability because most claims here are readily traceable to accidental cause. Nonetheless, there have been cases involving long exposure to fumes and other perils to cause concern over this limitation. Similarly, if a truck periodically bumps into a garage entrance with the result that it eventually topples over without apparent cause, a difficult time may be ahead in proving it an accident.

# Definition of Automobile

Although the Comprehensive Policy form is broad enough to automatically cover all of the named insured's automobile exposures, whether owned, hired or non-owned, there is some limitation in defining exactly what kind of equipment is an automobile. This is of importance to contractors.

For example, aside from passenger cars, trucks, truck type tractors, trailers and semi-trailers, the following types are deemed "automobiles":

1) while towed by or carried on an automobile, BUT NOT OTHERWISE:
(a) crawler type tractors
(b) crawler type power cranes or shovels
(c) crawler type ditch or trench diggers
(d) farm type tractors
(e) concrete mixers other than mix-in-transit type
(f) graders, scrapers, rollers or farm implements
(g) any other equipment not specified in (2) below if designed for use principally off public roads and not subject to motor vehicle registration
