OSHA Revises Information Poster Requirements. OSHA has given approval to 3 information posters to be used to inform employees of their rights under the Occupational Safety and Health Act. Although the original black & white poster is no longer distributed, it still carries the approval of OSHA. The second poster is a larger color addition which is available in limited numbers. A new one, which will be distributed soon, is a compact black & white version of the color poster. The content of all three posters is esssentially the same. Currently a federal poster must be displayed in all establishments covered by the Act, including those locations in the states which are operating under approved state plans. This means that the state poster and the federal poster must be displayed in some states. Inquiries pertaining to the poster requirements should be addressed to any OSHA regional office.
Michigan State Legislature Passes Enabling Legislation. On June 18, 1974 the governor of the state of Michigan signed a state job Safety and Health Enabling Law to become effective January 1, 1975. The state law provisions parallel federal law provisions in the following areas: employer responsibilities; permanent and temporary variance procedures; employee discrimination and penalties for serious and non-serious violations; failure to abate; willful and repeated violations, and posting requirements. Differences between the federal and state laws include provisions in the following areas; employee/employer responsibilities; employee response to imminent danger; inspection procedures; advance notice; issuance of citations; employee contesting of citations, and proposed penalties.
OSHA Re-issues Construction Rules. On June 24, 1974, the Occupational Safety and Health Administration re-issued the construction Safety and Health Standards. The standards appear in part on 1926, Title 29, Code of Federal regulations. The revised standards include all changes made before June 3, 1974.
Legislation Introduced to Amend Job Safety and Health Act. Sen. Henry L. Bellmon (R.-Okla.) has introduced legislation to amend the current Occupational Safety and Health Act by exempting small businesses having 25 or fewer employees from the standards. According to Bellmon, the amendments would remedy many of the present abuses which have been caused by the improper implementation of the Act. According to the Senator, the Act has caused hardships on small businesses, especially farmers. Other features of the amendment include a provision of employee-requested consultation visits by the Department of Labor with no authority to issue citations. A consultation would apply only to plants with 100 or fewer employees.
