vestigation and only to that contractor's operations within Idaho. However, the action taken by the Supreme court would indicate that other contractors who are faced with the same kind of surprise inspections would have the right to apply for a similar injunction, and it would be expected that a federal court would grant a similar injunction as was granted in the Idaho case.

The Department of Labor, without regard to the limitations placed on the injunction by the Supreme Court, intends to continue making surprise investigations. We now must await the decision of the U.S. Supreme Court which will definitely affect the entire operations of the Department of Labor with respect to surprise investigations and inspections without prior notification to the employer or contractor.

No matter what action is taken by the Supreme Court on the Idaho decision, OSHA itself has been found constitutional, and the issues that will be decided by the court is limited simply to the inspection procedures.
